Terms of Service

1. Acceptance of Terms

By accessing or using Fortifaith ("the Service"), operated at fortifaith.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes your acceptance of the updated Terms.

2. Description of Service

Fortifaith is a storytelling and generosity platform for missionaries, church planters, educators, and ministry organizations. It enables creators to share their work, receive financial support, manage volunteer opportunities, and build communities of supporters.

3. Eligibility

You must be at least 13 years old to use Fortifaith. By creating an account, you represent that you are at least 13 years of age. If you are under 18, you represent that you have permission from a parent or legal guardian to use the Service.

To make or receive donations, you must be at least 18 years old and legally capable of entering into binding contracts in your jurisdiction.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@fortifaith.com of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

5. User Content

You retain ownership of content you post on Fortifaith ("User Content"). By posting User Content, you grant Fortifaith a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating the Service.

You agree not to post User Content that:

• Is false, misleading, or fraudulent.
• Is defamatory, harassing, abusive, threatening, or obscene.
• Infringes on any third party's intellectual property rights.
• Contains malware, viruses, or harmful code.
• Violates any applicable law or regulation.
• Solicits personal information from minors.

We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, without notice.

6. Donations and Payments

Fortifaith facilitates donations between supporters and creators. All payments are processed by Stripe. By making a donation, you agree to Stripe's Terms of Service.

Fortifaith charges a platform fee (currently 5%) on each donation to cover operating costs. This fee is deducted from the donation amount before the creator receives the remainder.

Refunds: Donations are generally non-refundable once processed. Exceptions may be made in cases of fraud or unauthorized transactions. Contact support@fortifaith.com within 7 days of the transaction to request a review.

Creator payouts: Creators are responsible for completing Stripe Connect onboarding to receive payouts and for complying with all applicable tax laws in their jurisdiction. Fortifaith does not provide tax advice.

7. Creator Responsibilities

Creators who use Fortifaith to receive donations represent that:

• The ministry or organization described on their profile is legitimate and accurately represented.
• Funds received will be used for the stated ministry purposes.
• They will comply with all applicable financial, charitable, and tax regulations in their jurisdiction.
• They will complete Stripe's identity verification process honestly and accurately.

8. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to any part of the Service.
• Scrape, crawl, or use automated tools to access the Service without our written permission.
• Impersonate any person or entity.
• Use the Service to send spam or unsolicited messages.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service to facilitate money laundering, fraud, or other financial crimes.

9. Intellectual Property

The Fortifaith name, logo, and platform design are the intellectual property of Fortifaith. You may not use our trademarks or branding without our written permission.

All software, design, and content provided by Fortifaith (excluding User Content) is protected by copyright and other intellectual property laws.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FORTIFAITH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO USE THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

12. Indemnification

You agree to indemnify and hold harmless Fortifaith, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in connection with your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time from your account settings.

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination will survive.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the United States.
